The Advocate, NOTICE - - - PROCEEDINGS OF THE COUNCIL OF THE PARISH OF WEST FELICIANA, STATE OF LOUISIANA, TAKEN AT THE FIRST REGULAR MONTHLY MEETING HELD ON MONDAY, JULY 13, 2015. The Council of the Parish of West Feliciana, State of Louisiana, met in regular session at its regular meeting place, the Council Meeting Room on the second floor of the Courthouse Annex, 4785 Prosperity Street, St. Francisville, Louisiana on Monday, July 13, 2015 at Five-Thirty (5:30) p.m. Chairperson Heather R. Howle called the meeting to order and directed the Secretary, Rolanda J. Robinson to call the roll: PRESENT: Hon. Chair Heather R. Howle and Council Members Mel Percy, Melvin Young, Merrick Ricky Lambert, John S. Kean, IV and Otis L. Wilson. ABSENT: Lea Reid Williams OTHERS: Parish President, Kevin Couhig, District Attorney (DA) Sam DAquilla and Assistant District Attorney (ADA) Michael L. Hughes. 3. PRAYER & PLEDGE Those who liked joined in the saying of the Lords Prayer and the Pledge of Allegiance. 4. RULES OF MEETING ORDER The Chair stated that the meeting would be conducted under Roberts Rules of Order with deviations as seen fit by the Chair. 5. PUBLIC COMMENT REQUESTS SUBMITTAL OF FORMS The Chair asked those who wanted to make comments on a specific agenda item to please fill out the form and turn them in to the Council Secretary so they can be recognized at the proper time. 6. APPROVAL OF AGENDA ITEMS FOR CONSIDERATION AND ACTION Mr. Percy made a motion to approve the agenda items for consideration and action as submitted [except 8.C. and 8.D.] Seconded by Mr. Wilson. There was no opposition. Motion carried 6-0-1. Mr. Percy made a motion to add the verbiage for items 8.C. and 8.D. [as amended]. Seconded by Mr. Wilson. Lambert abstained. Motion carried 5-0-1-1. 7. APPROVAL OF PARISH COUNCIL MINUTES Moved by Mr. Percy to approve the minutes from the regular meeting of June 22nd, 2015 as written. Seconded by Mr. Lambert. There was no objection. Motion carried 6-0-1. 8. PUBLIC HEARING At 5:33 p.m., upon a motion of Mr. Percy, seconded by Mr. Kean the Council entered into public hearing. 8.A. ADOPT AND/OR MAKE CHANGES TO AN ORDINANCE AMENDING THE WEST FELICIANA PARISH OPERATING FUND BUDGET FOR FY 2014-2015 (BUDGET REVISIONS) Ms. Johnson presented the budget revisions for the General Fund [#2], Parks & Recreation Fund [#1], Road Fund [#1] and a revised Water Fund [#1] from what was previously submitted. She explained the revenue increase [rather than revenue decrease] for water sales and LGAP funding. Mr. Percy withdrew his motion to accept the amendment. Mr. Lambert then made a motion to increase water sales by $80,000.00 and LGAP funding in the amount of $38,040.00. for a total of $118,040.00 and revenue over expenditures of $69,635.00. There was no objection. Motion carried 6-0-1. For the record, Mr. Lambert later in the meeting acknowledged his vote on the above item which he should have abstained. 8.B. INTRODUCE AN ORDINANCE TO MERGE VOTING PRECINCTS IN ACCORDANCE WITH PLAN 2A The Chair introduced the item and deferred to the Parish President for explanation who directed the Council to Mr. Hefners memorandum. 8.C. INTRODUCE AN ORDINANCE TO SETTLE THE FOLLOWING ENTITLED COURT CASE: LAMBERT GRAVEL, ET AL VS. PARISH OF WEST FELICIANA, SUIT NUMBER 21774, DIVISION A 20TH JUDICIAL DISTRICT COURT The Chair read aloud a summary of the ordinance and public comments were allowed by those who wished to do so. INTRODUCE AN ORDINANCE TO LEVY TAXES UPON ALL TAXABLE PROPERTY ON THE OFFICIAL ASSESSMENT ROLL FOR THE YEAR 2015 The Council Chair read aloud a summary of the ordinance and the Parish President deferred to the Finance Director, Ms. Johnson to further details. [A summary of the ordinance was published in the July 23, 2015 edition of the Official Journal, the Advocate Extra, a weekly newspaper of general circulation published in St. Francisville, Clinton and Greensburg, Louisiana.] 8.E. INTRODUCE AN ORDINANCE PROPOSING TO THE QUALIFIED ELECTORS OF WEST FELICIANA PARISH AMENDMENTS TO THE HOME RULE CHARTER OF WEST FELICIANA PARISH CALLING THE ELECTION AT WHICH SAID PROPOSED AMENDMENTS SHALL BE SUBMITTED TO THE VOTERS The Chair read aloud a summary of the ordinance for introductory purposes. TAKE ACTION DEEMED NECESSARY At 5:51 p.m., upon a motion of Mr. Percy, seconded by Mr. Kean the Council ended the public hearing and returned to regular session. Moved by Mr. Percy to adopt Ordinance No. 2015 July 13 as amended. Seconded by Mr. Lambert. Upon a roll call vote, Percy, Young, Lambert, Howle and Wilson voted in favor of the motion. Casting the only dissenting vote was Kean. Motion carried 5-1-1. Moved by Mr. Percy to set the date and time of the public hearing for the regular meeting of August 10, 2015 at 5:30 p.m. in this meeting room for item 8.C. Seconded by Mr. Young. Mr. Lambert abstained and objection was voiced. Upon a roll call vote, voting in favor of the motion were Percy, Young and Howle. Casting dissenting votes were Kean and Wilson. Lambert abstained. Motion carried 3-2-1-1. Mr. Percy made a motion to set the date and time of the public hearing for the regular meeting of August 10, 2015 at 5:30 p.m. in this meeting room for item 8.D. Seconded by Ms. Howle. There was no objection. Motion carried 6-0-1. Moved by Mr. Young to set the date and time of the public hearing for the regular meeting of August 10, 2015 at 5:30 p.m. in this meeting room for item 8.E. Seconded by Mr. Kean. Discussion ensued and additional public comments were allowed. Upon a roll call vote, Young, Lambert, Kean and Wilson voted in favor of the motion. Casting dissenting votes were Percy and Howle. Motion carried 4-2-1. 9.A. PLANNING & ZONING COMMISSION RECOMMENDATION TO COUNCIL REGARDING LAND DEVELOPMENT CODE MATTERS ON THE RECODIFICATION PROJECT WITH MUNICODE DISCUSS AND/OR TAKE ACTION DEEMED NECESSARY The Administrator, Jim Ferguson explained the recommendations which a few were conditional, however, he could not find justification, therefore, the reply should reflect a no response. Moved by Mr. Lambert to accept the recommendation of Planning & Zoning with conditional amendments replied NO, send to Municode and direct them [Municode] to print. Seconded by Mr. Kean. There was no objection. Motion carried 6-0-1. 9.B. PROPOSED DONATION FROM ESTATE OF PAUL A. LAMBERT, SR. TO WEST FELICIANA PARISH DISCUSS AND TAKE CATION DEEMED NECESSARY Ms. Howle introduced the matter and requested the assistance of the Parish President to work on a resolution. 9.C. PRESENTATION ON TAX RENEWAL PROPOSITIONS DISCUSS AND TAKE ACTION DEEMED NECESSARY Mr. Couhig conducted a presentation on the proposal for a tax election this November 21st. The 2016 Tax Renewal Plan consisted of no raise in tax rates and a reallocation of existing taxes. He then explained each of the four (4) propositions followed by a rendition of a two-part complex that includes a Health and Wellness Center.
